Kane County State's Attorney, Police Plan Halloween Weekend Anti-DUI Initiative

Kane County State's Attorney Jamie L. Mosser announces that Kane County police agencies will work with the State's Attorney's Office on an impaired driving abatement initiative the weekend before Halloween, on Saturday, October 28, 2023.

The initiative, called a No-Refusal operation, is designed to assist police efforts to obtain a search warrant for individuals who refuse to submit to chemical testing after a DUI arrest. Assistant State's Attorneys are on hand to assist police officers through the search warrant process to compel a DUI suspect to submit to a lawfully requested blood, breath or urine test as required by Illinois law.

Illinois courts have held that a person has no right to refuse chemical testing when probable cause exists. Anyone who declines to submit to chemical testing after being presented with a search warrant should expect to face additional charges.

SA Mosser said:  “Everyone is at greater risk when an impaired person is behind the wheel of a car. Halloween weekend has become an excuse for adults to drink too much or use drugs to the point of intoxication and get into a car.  With this also being a weekend where more children are out, people be responsible and use alternative transportation, such as designated drivers, taxis, Uber and Lyft. We partner with police to obtain search warrants so we can get the evidence to prosecute anyone who chooses to compromise public safety. My thanks to all in law enforcement who will be patrolling that night. I hope everyone gets home safe."

The Kane County State's Attorney's Office has been working with local police on the No-Refusal operations since 2008.
