Kane County Associate Judge David P. Kliment has found 26-year-old old Justin D. Devine guilty of the offense of nonconsensual dissemination of a sex image, a Class 4 felony.
Devine waived his right to a jury trial. Kliment delivered his verdict on Jan. 15.
Kane County Assistant State’s Attorneys Katy Flannagan and David Belshan presented evidence that on Sept. 19, 2018, the victim visited a Verizon retail store in the 12000 block of Route 47, Huntley.
The victim gave her cell phone to Devine, a store employee, for him to assist her. While Devine had the victim’s phone he transferred to his personal cell phone from the victim’s phone, without the victim’s permission, five sexual images she had of herself on her phone.
When confronted by Huntley police, Devine admitted that the victim’s accusations were true. Huntley police found the images on Devine’s cell phone.
Kliment set Devine’s next court appearance for 1:30 p.m. March 24, 2021, in Courtroom 305 at the Kane County Judicial Center for motions and sentencing. Devine faces a sentence of between one and three years’ imprisonment in the Illinois Department of Corrections, or probation.
Devine remains free on $1,500 bond.
