Herrera Serves as Kane County Interim Acting Treasurer

The Kane County Board on Tuesday (Jan. 12, 2021) passed a resolution naming Maria Herrera as the interim acting treasurer, following the Jan. 3 resignation of longtime Treasurer David Rickert.

According to the resolution summary, when a vacancy occurs in any elective county office, the County Board must declare that such vacancy exists and give notice to the county central committee of the elected official’s political party.

Rickert, who resigned after taking a job a the chief financial officer of Rockford-based Winnebago County, is a Republican, so the Republican Central Committee of Kane County has the responsibility of nominating a successor treasurer to fulfill the statutory duties until the next election cycle.

Kane County Madam Chairman Corinne Pierog will then make the appointment, which must be approved with the advice and consent of the County Board. By law, the appointment must be made within 60 days of the resignation.

Herrera is serving as interim acting treasurer until the appointment is made.

Herrera is a longtime public servant, working with the Treasurer’s Office for nearly 25 years, including the past five-plus years as deputy treasurer.

Duties of the Kane County Treasurer

The County Treasurer has the duty and power to receive and safely keep the revenue and public monies of the county.

The county treasurer must keep an account of all monies received. The county treasurer also keeps accounts of all monies paid out, stating the time, to whom payment is made, and on what account payment has been made.

The County Board must authorize all payments, or they must be specifically authorized by law.

It is also the duty of the county treasurer to invest and reinvest any funds which are not to be used within 30 days. The county collector is charged by the county clerk to collect all of the taxes levied by approximately 270 local taxing bodies within Kane County. Upon receipt of the collector books from the county clerk, the county collector prepares tax bills for real estate taxes within the county and mails them to owners of record.

Distribution of tax receipts is made at least monthly to the various taxing districts during the collection period. Along with the collection of real estate taxes, the county treasurer also collects the Mobile Home Local Service Tax and administrates for the Department of Revenue the Senior Citizens real estate tax deferral program.

RESOLUTION: NO. 21 – 24
DECLARING A VACANCY IN THE OFFICE OF TREASURER AND APPOINTING AN
INTERIM ACTING TREASURER

WHEREAS, the David Rickert was elected the Treasurer of Kane County in November, 2018, to serve a term of office for four years; and

WHEREAS, on January 1, 2021, Treasurer Rickert notified the Kane County Board Chairman that he was resigning from the Office of Kane County Treasurer, effective January 3, 2021, at 10:00 pm, thereby creating a vacancy in said office; and

WHEREAS, the Illinois Counties Code at 55 ILCS 5/3-10020 states that a vacancy in the office of county treasurer shall be filled pursuant to the Illinois Election Code, and that the Election Code at 10 ILCS 5/25-11 provides that when a vacancy occurs in any elective county office, the county board shall declare that such vacancy exists and notice shall be given to the county central committee or the appropriate county board district committee of each established political party within 3 days of the occurrence of the vacancy. The vacancy shall then be filled within 60 days by appointment of the chair of the county board with the advice and consent of the county board. The
appointee shall be a member of the same political party as the person he/she succeeds was at the time of his election and shall be otherwise eligible to serve. Where less than 28 months remain in the term, the appointee shall serve the remainder of the unexpired term; and

WHEREAS, on January 6, 2021, the Executive Committee of the Kane County Board and the central committees of each established political party within Kane County were informed of Treasurer Rickert’s resignation and the vacancy in the Office of the Kane County Treasurer; and

WHEREAS, the Chairman and the Kane County Board desire to conduct interviews and carefully consider the appointment of a new Kane County Treasurer; and

WHEREAS, the Office of the Kane County Treasurer must remain open to perform statutory duties and perform critical operations for the County during the interim period of time until a successor Treasurer can be appointed; and

WHEREAS, to maintain a continuity of operations and signatory authority on behalf of the Office of the Kane County Treasurer, the Chairman and the County Board desire to appoint an Interim Acting Treasurer to direct the operations and fulfill the statutory duties of the Kane County Treasurer’s Office until a successor Treasurer can be appointed; and

WHEREAS, Maria Herrera is currently employed by the Kane County Treasurer’s Office as the Chief Deputy Treasurer, and is otherwise qualified to serve as an Interim Acting Treasurer until a successor Treasurer is appointed in accordance with statute, and the Chairman and the County Board desire to appoint Ms. Herrera as the Interim Acting Treasurer; and

NOW, THEREFORE, BE IT RESOLVED THAT the Kane County Board hereby declares a vacancy in the Office of the Kane County Treasurer and hereby consents to the Chairman’s appointment of Maria Herrera as the Interim Acting Treasurer until a successor can be appointed in accordance with law. Ms. Herrera shall be paid the salary approved by the County Board as set forth in the Kane County Code and as provided by law during the interim period.
