Elgin Man Found Guilty of Aggravated Battery in a Public Way

A Kane County jury on Oct. 1, 2020, found 36-year-old Damian A. Failla guilty of the offense of aggravated battery on a public way, Class 3 felony.

According to a Kane County State’s Attorney’s Office news release, Assistant State’s Attorneys Mark D. Stajdohar and Joseph Gay presented evidence that on Sept. 24, 2019, Failla and the victim became engaged in a running dispute.

Later that day, Failla again saw the victim and the two exchanged words. The victim walked away and Failla followed. Failla then approached the victim and struck her repeatedly about the head, causing a laceration.

Failla’s next court appearance for 1:30 p.m. Dec. 1, 2020, in Courtroom 319 at the Kane County Judicial Center for motions and sentencing. Failla faces a sentence of probation or between 2 and 10 years’ imprisonment in the Illinois Department of Corrections.

Failla remains in custody at the Kane County jail, where he has been held since his/her arrest in lieu of $50,000 bail. The judge revoked Failla’s bond upon conviction.
