Bail Set at $1 Million For Elgin Man Accused of Disseminating Child Pornography

Bail has been set at $1 million for an Elgin man accused of disseminating child pornography.

Kane County State’s Attorney Joe McMahon has charged 51-year-old Jose J. Chavez Hernandez with the offenses of:

  • Two counts of reproducing child pornography/victim younger than 13, a Class X felony.
  • Disseminating child pornography, a Class 1 felony.
  • Three counts of possessing child pornography, a Class 2 felony.

Kane County prosecutors allege that on March 10, 2020, Chavez Hernandez uploaded multiple files of child sexual assault/abuse material to a social media site. Elgin police detectives opened an investigation after receiving information about the videos from the National Center for Missing and Exploited Children.

NCMEC was alerted by Facebook.

After an extensive investigation, Elgin police detectives took Chavez Hernandez into custody on Oct. 4, 2020. Chavez Hernandez is alleged to have uploaded the videos in Elgin from his mobile phone.

Chavez Hernandez appeared Oct. 5, 2020, in Kane County bond court. His bail was set at $1 million, with 10 percent ($100,000) to apply for bond.

His next court appearance is set for 9 a.m. Oct. 9, 2020, in Courtroom 305 at the Kane County Judicial Center.

The charges against Chavez Hernandez are not proof of guilt. Chavez Hernandez is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove his guilt beyond a reasonable doubt.

The Elgin Police Department, in conjunction with the National Center for Missing and Exploited Children and the Internet Crimes Against Children Task Force of the Illinois Attorney General’s Office, conducted the investigation.
