Elgin Man Faces Charges For Allegedly Beating Homeless Man

Kane County State’s Attorney Joe McMahon has charged 19-year-old Isaac C. Diaz with the offenses of:

  • Robbery – victim 60 or older, a Class 1 felony
  • Aggravated battery – great bodily harm/victim 60 or older, a Class 2 felony
  • Aggravated battery, a Class 3 felony, 2 counts

Kane County prosecutors allege that early the morning of July 20, 2020, Diaz and the victim, who is homeless and older than 60, were smoking marijuana and drinking beer together in vicinity of East Chicago Street and South Grove Avenue in Elgin.

The two had a disagreement, and Diaz pushed the victim to the ground and punched the victim in the face several times. Money fell from the victim’s pocket. Diaz picked up the money and fled the scene. The victim remains hospitalized with severe head and facial injuries.

Kane County Judge Salvatore LoPiccolo set Diaz’s bail at $50,000, with 10 percent ($5,000) to apply for bond.

LoPiccolo set Diaz’s next court appearance for 9 a.m. July 29, 2020, in Courtroom 313 at the Kane County Judicial Center.

The charges against Diaz are not proof of guilt. Diaz is presumed innocent and is entitled to a fair trial in which it is the state’s burden to prove his guilt beyond a reasonable doubt.
